DEFINITIONS
The following definitions apply to the terms as they appear in this User Agreement & Terms of Service

MMNI means Moderation Management Network, Inc.

Software means the *ABSTAR* computer program and electronic service which MMNI offers as a feature on a web site under their control, with a domain name registered to MMNI. All copies of any part of the *ABSTAR* computer program and service are also included in this term.

Member means any user who has signed up for an *ABSTAR* account, either Public or Private.

COPYRIGHT / PROPRIETARY PROTECTION
The Software is owned by MMNI or its suppliers and is protected by United States and international copyright laws and international trade provisions. You must treat the Software like any other copyrighted material. This license and your right to use the Software terminate automatically if you violate any part of this agreement.

LICENSE GRANT
MMNI grants you a nonexclusive license to:

Use *ABSTAR* service as a non-commercial activity for personal use only. This access shall not include the duplication of the Software itself, but rather the use of the Software over the Internet.

You may not:
Modify, translate, or merge the Software with another program, except for use as an element of the *ABSTAR* service as approved by *ABSTAR* administration in writing on MMNI letterhead and signed by an authorized MMNI representative.
Reverse-engineer, disassemble, decompile, or make any attempt to discover the source code or programmer access passwords of the Software.
Sublicense, rent, or lease any portion of this Software. You may, after written notification to MMNI, transfer the entire Software on a permanent basis to another person or entity provided you retain no copies of the Software and the recipient agrees to the terms of this agreement. If you have received an update to the Software, any transfer must include the update and all prior versions of the Software.

LIMITED WARRANTY
MMNI warrants the web site on which the Software is distributed to be constructed so pages may be able to be displayed on a standard Internet browser. No further warranty, implied or written, can be made for the services provided by the Software, or for the functionality and appropriate nature of the service which the Software will perform. Any written or oral information or advice given by MMNI representatives or *ABSTAR* administration will in no way increase the scope of this warranty.

If the Software fails to comply with the warranty set forth above, the entire liability of MMNI and your exclusive remedy will be removal of the Member account from current *ABSTAR* service pages. Or, at the option of MMNI, MMNI may make make a reasonable effort to have the Software meet the warranty as set forth above. These remedies are not available outside the United States and Canada.

MMNI DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF SERVICEABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM STATE TO STATE.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES
In no event shall MMNI, *ABSTAR* administration, or their representatives be liable for any damages whatsoever (including, without limitation, emotional distress, damages for lack of income, loss of profits, business interruption, loss of information, or other pecuniary loss) arising out of the use of or inability to use this Software, even if MMNI has been advised of the possibility of such damages. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. The forgoing limitations of warranty and liability inure to the benefit of MMNI *ABSTAR* Members that have an interest in this package.

GENERAL
This agreement constitutes the entire agreement between you and MMNI and supersedes any prior agreement concerning the Software. It shall not be modified except by written agreement dated subsequent to the date of this agreement signed by an authorized MMNI representative. MMNI is not bound by any provision of any receipt, acceptance, confirmation, correspondence, or otherwise, unless MMNI specifically agrees to the provision in writing. This agreement is governed by the laws of the State of Michican.

*ABSTAR* will not be used for commercial use, or for any for-profit activity. The images presented here and the content that is shown here are fully owned by Moderation Management Network, Inc. (MMNI), and will not be used by and for any other purpose beyond those presented here without the express written consent of MMNI or their authorized representatives.
*ABSTAR* administrates Member's access to the service using a technique known as "cookies". NO personal information is stored with these cookies, only a coded ID number and the date that the password was last changed. Stored logins will last "forever" on the computer where they are created, or until the cookie is deleted from that system. Stored logins will become invalid after a change of password, based on the stored date of the password change in each cookie. Logins to *ABSTAR* do not require a permanent cookie; a single-session cookie is created with logins where the "Remember Login" check box is not checked. However, the system remains reliant on cookies for managing user authentication.
Passwords that are entered into the system are encrypted automatically, with a technology (UNIX "crypt" command) that makes it impractical for us to decrypt them. We do not intend to know the password that any user has placed on the system, and in reality lack any mechanism that would show us these passwords once they are recorded in their encrypted form. Passwords for any user account, however, may be changed administratively at any time and without notice as required by *ABSTAR* administrators or MMNI representatives or authorized representatives performing standard duties.
User accounts are granted as a courtesy by MMNI to users of the *ABSTAR* service. This courtesy may be revoked at any time, for any reason, by MMNI, *ABSTAR* administrators, or authorized representatives.
*ABSTAR*, and MMNI, makes no claims to privacy beyond good faith expectation explained here. We cannot be held liable for any release of personal information, including data that is entered here, should such a release occur. The design of the site is to minimize personal information that can be exposed without a user's consent. Private *ABSTAR* users will not appear on public *ABSTAR* monthly pages unless those pages were first created when the user was a Public user. All personal information is held in an area of the web site that cannot normally be accessed by browsers unless specific authorization has been granted by *ABSTAR* administrators.
*ABSTAR* information may be used for research for any purpose or project that MMNI decides to use such data for, with the following limitations agreed upon by MMNI. No personal information will be released, only code numbers, gender, and associated monthly and daily information. There will be no relation made between individuals names and personal information in any data approved for use in research by MMNI. *ABSTAR* is an important tool, both for *ABSTAR* users and for MMNI to help understand the extent of the problems our Members experience and how these problems can be best resolved. By using *ABSTAR* as a tool to help themselves, Members will also benefit both MMNI and those Members who come after.
*ABSTAR* expects all Members to meet civil norms of behavior for a social setting. The use of MMNI Internet services, including *ABSTAR*, to communicate offensive material is totally unacceptable, and is inconsistent with our insistence on a mutually respectful Internet environment. Any Member engaging in such activity should assume that their *ABSTAR* account will be terminated. Storage, use, or interaction with web services that feature pornography, off-color jokes, hate speech and the like is strictly prohibited under this User Agreement & Terms of Service. Failure of other Members to report such activities when discovered is considered sponsorship of this behavior, and carries equivalent sanctions.
All information stored on this service becomes the property of MMNI. We encourage Members to use this service to track important personal information, and will make every effort to treat this information in a confidential and respectful manner. However, all information managed by this web site automatically becomes the property of MMNI.
In addition, all electronic communications using MMNI systems, including contact pages, SMTP access, Electronic Mail, Internet and Intranet messaging, and other similar transmissions become the property of MMNI, except where local, state, and federal laws apply. If the service is funded and administrated by MMNI, MMNI owns the content of all transmissions on that service.
No use of encrypted messages, special passwords, and similar "restrictive" technologies that deny proper supervision or administration of Internet activity will be acceptable except by the specific written permission of MMNI or *ABSTAR* administration. The contents of individual user's *ABSTAR* accounts are subject to review by MMNI or *ABSTAR* administration at any time.
US GOVERNMENT RESTRICTED RIGHTS
The Software is provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the government is subject to restrictions as set forth in subdivision (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at 48 CFR 252.227-7013, or in subdivision (c)(1) and (2) of the Commercial Computer Software- Restricted Rights clause at 48 CFR 52.27-19 as applicable.
